Early return of Driving Licence

Have you been disqualified from driving and want the early return of your driving licence?

If yes, the law does allow you to make an application under section 42 of the Road Traffic Offenders Act 1988.

Under that section, the Court can consider an application for the early return of driving licence, if the minimum required period of disqualification has been served. Those periods are:

  • 2 years if the disqualification is less than 4 years
  • Half the period of the disqualification, if the ban was between 4 and 10 years
  • 5 years if the disqualification was for 10 years or longer

The Court will look very carefully at each application. The application may be opposed by the Crown Prosecution Service and the Police. The Court will look at the offence that gave rise to the disqualification. Also the character and conduct of the applicant since the disqualification was imposed, together with the reason why the driving licence should be returned early. Just wanting your licence back will not been seen as a good enough reason for the Court to hand you your driving licence back early.

If the Court refuses your application for the early return of driving licence, you can make a further application after 3 months.
